These terms describe the basic rules for using the HUsend website, API, SMTP relay, and administrative tools. A signed commercial agreement or order form may add or replace terms for a specific customer.
1. Access and accounts
You must provide accurate information, keep credentials confidential, use multi-factor authentication when offered, and promptly report suspected unauthorized access. You are responsible for activity performed with your credentials and integrations.
2. Acceptable sending
You may send only lawful, expected, and permission-based messages. Purchased, harvested, or unlawfully obtained lists, phishing, malware, deceptive content, evasion of provider controls, and unsolicited bulk email are prohibited. You must honor opt-outs, privacy rights, and applicable messaging rules.
3. Plans, trials, and limits
Sending rates, storage, retention, support windows, and features depend on the agreed plan. Applicable capacities, limits, and service levels are defined in the commercial proposal or signed agreement. Trials may require approval and may be limited or ended to protect the service.
4. Availability and deliverability
Email acceptance, delivery, inbox placement, and timing depend on recipient providers, sender reputation, content, DNS, and network conditions. HUsend does not promise a delivery rate, uninterrupted availability, or a service level unless it is expressly stated in a signed agreement.
5. Customer data and security
You retain responsibility for your content, recipient permissions, domain configuration, account users, and lawful instructions. HUsend processes service data to operate and secure the platform as described in the Privacy Policy.
6. Suspension and termination
Access may be limited or suspended when needed to stop abuse, protect systems or third parties, respond to legal requirements, investigate risk, or address non-payment or a material breach. When practical and safe, HUsend will provide notice and a path to remediation.
7. Third-party services and responsibility
External networks and providers operate under their own terms. To the extent allowed by applicable law, each party is responsible for losses caused by its own breach, unlawful conduct, or misuse. Any specific warranties, credits, limits, or liability allocation must be stated in the signed commercial agreement.
